At this time members of the public can address the RCA Board of Directors regarding any items within the subject matter jurisdiction of the Board that are not separately listed on this agenda. Members of the public will have an opportunity to speak on agendized items at the time the item is called for discussion. No action may be taken on items not listed on the agenda unless authorized by law. Each individual speaker is limited to speak three (3) continuous minutes or less. Any person wishing to address the Board on any matter, whether or not it appears on this agenda, is requested to complete a Request to Speak form available at the door. The completed form is to be submitted to the Clerk of the Board prior to an individual being heard. Whenever possible, lengthy testimony should be presented to the Board in writing and only pertinent points presented orally. Any written documents to be distributed or presented to the RCA Board of Directors shall be submitted to the Clerk of the Board.

5. ADDITIONS/REVISIONS
  (The Board may add an item to the Agenda after making a finding that there is a need to take immediate action on the item and that the item came to the attention of the Board subsequent to the posting of the agenda. An action adding an item to the agenda requires 2/3 vote of the Board. If there are less than 2/3 of the Board Members present, adding an item requires a unanimous vote. Added items will be placed for discussion at the end of the agenda.)

  7.1 APPROVAL OF RESOLUTION NO. 07-11, "RESOLUTION OF THE BOARD OF DIRECTORS OF THE WESTERN RIVERSIDE COUNTY REGIONAL CONSERVATION AUTHORITY AMENDING THE AUTHORITY'S BYLAWS"

    This item is for the RCA Board of Directors to approve Resolution No. 07-11, which includes the appointment procedures for Board of Supervisors alternates. The introduction of Resolution No. 07-11 was on the December 3, 2007 RCA Board agenda.
 
  7.2 FISCAL YEAR 2006-07 FINANCIAL STATEMENTS AND INDEPENDENT AUDITORS' REPORTS OF THE WESTERN RIVERSIDE COUNTY REGIONAL CONSERVATION AUTHORITY

    This item is for the RCA Board of Directors to ratify the Executive Committee's action on the Fiscal Year 2006-07 Financial Statements and Independent Auditors' Reports.
 
  7.3 VEGETATION MANAGEMENT PROGRAM AGREEMENT WITH THE CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION TO DEVELOP A PRESCRIBED BURN PLAN FOR RCA PROPERTIES

    This item is for the RCA Board of Directors to:
 
    1) Adopt the Vegetation Management Program Agreement as currently negotiated by Legal Counsel;
 
    2) Allow Legal Counsel to continue to negotiate toward improved property damage provisions.
 
  7.4 AGREEMENT BETWEEN THE WESTERN RIVERSIDE COUNTY REGIONAL CONSERVATION AUTHORITY AND THE U.S. FISH AND WILDLIFE SERVICE FOR A POSITION DEDICATED TO THE IMPLEMENTATION OF THE MSHCP

    This item is for the RCA Board of Directors to:
 
    1) Approve the Agreement between the RCA and USFWS for a GS-14 Policy Level Position;
 
    2) Authorize the Chairman to execute said agreement on behalf of the Authority; and
 
    3) Approve the Budget Adjustment contained in the Financial Information section of the staff report.
 
  7.5 RATIFICATION OF THE CHAIRMAN'S APPOINTMENT OF THE 2008 WESTERN RIVERSIDE COUNTY REGIONAL CONSERVATION AUTHORITY EXECUTIVE COMMITTEE

8. DISCUSSION ITEMS
 
  8.1 AUTHORIZATION TO PURCHASE AN APPROXIMATELY 70-ACRE PROPERTY FROM THE COUNTY OF RIVERSIDE
    Overview - Staff Report
 
    This item is for the RCA Board of Directors to authorize:
 
    1) The acquisition of approximately 70 acres from the County of Riverside, as shown on the attached exhibit, and subject to receiving the necessary funds from SMR Ventures;
 
    2) The use of donation funds to be provided by SMR Ventures to pay for the purchase;
 
    3) Staff to finalize the purchase and sale agreement, subject to Legal Counsel's review and approval;
 
    4) The Chairman of the Board of Directors to execute the purhcase and sale agreement; and
 
    5) The Executive Director or his designee to execute escrow documents, including the certificate of acceptance.
